251 Dartmouth Road for sale, not a grand design!
251 Dartmouth Road for sale, not a grand design!
To be auctioned by Allsops, the building has not been built to plan, original plans are incorrect ( and not checked by planners) and neighbours were not consulted on the some what hasty planning consent.
Neighbouring buildings have been damaged and overlooked, legal proceedings remain ongoing, there is a sign in 101 Kirkdale which explains a few issues that they have with the building, I took a photo but have no idea how to put the sign on so basically this is what it days-
Notice to all prospectice purchasers of 251 Dartmouth Road, london se26
As owners of the neighbouring property we would advice you of the following issues affecting the above mentioned property
- There is currently ongoing legal action in respect of trespass and breach of the party wall etc act 1996
- We have an injuction currently preventing the adjoinging owners from carrying out any further works on their property pending an award by Graham North Of Anstey Horne, which is currently subject to an appeal by the building owner
-The award provides for the blocking up of all windows on the party wall
-Matters of underpinning are in dispute
-There is a flying freehold
-The boundary between the properties remains unresolved
Longstaff Investment Inc
( I'm not an employee just someone who has also been affected by this shoddy building)

Have just looked this property up on their auction website.
http://www.auction.co.uk/residential/Lo ... 11&S=C&O=A
Hope whoever bids has a good solicitor for the conveyancing, could be a right can of worms.

Re: 251 Dartmouth Road for sale, not a grand design!
Bump, Lewisham planning dept have still not taken any enforcement action on this property since learning it is to be auctioned, despite meeting with the developers in January.
Numerous emails to Jim Dowd, lewisham councillors, planners etc have brought no action.
If this building is sold as it (not built to plan, damage to others property and directly overlooking residential properties , ie windows looking into bathrooms etc no more than 10 metres away) then Lewisham are likely to loose any future planning control, according to the Government ombudsman who investigated late last year.
We may be stuck with this if Lewisham continue to take no action.
I'm furious, any suggestions would be welcomed.

Perhaps our local Cllrs should take up the case?
Write to everyone including the mayor to put pressure on the various departments. Perhaps the Sydenham Society can champion it and write about it on their news letters to put more pressure on people. Jim Dowd is pretty useless when it comes to local matters (from experience) but putting pressure on Sir Steve does at least get somethings moving.
Hopefully the Kirkdale Traders will all help out more pressure on the departments that need a bit of a nudge too.

Thanks, Alex Feakes is aware (For the past 18 months at least, and updated with my numerous emails) and has visited to see the damage and the impact on surrounding properties, i believe he has a role in the planning dept, still nothing.
I recently mentioned it to Chris Best and she said she would look into it.
I have emailed the deputy mayor but will also try the mayor too, thanks. My complaint is now being looked at again by lewisham council, i have been told i will hear by 31/5, no good really as it is to be auctioned on either the 29th or 31st.
Kirkdale traders are aware. Sydenham society are aware, and have been very supportive. The latest advice I've received was to go to a solicitor, any further advice is really appreciated.

I know we have spoken about this before and I know how frustrating it can be when you have a bad neighbour and the council don't do anything and it seems as if your pleas are ignored. Good luck Bag Lady.

Have checked the Allsop website again and 251 Dartmouth Road did sell at auction today.
I noticed however an updated to the properties auction page:
Addendum for Lot Number 204
251 Dartmouth Road, Lewisham
We have been informed by the vendor's solicitors that:
1 The third surveyor's award included in the Auction Pack was preceded by a joint submission to the third surveyor on behalf of the Seller and Longstaff (as defined in the extra special conditions). A plan is annexed which the Seller has been informed by Longstaff is the plan contained in divider 8 of the appendix to that joint submission to the third surveyor.
2. Any purchaser wishing to establish the planning status of the works carried out at the property is recommended to contact the planning officer, Geoff Whitington on 020 8314 9530 prior to the auction.
For the avoidance of doubt there is an injunction forbidding further development work at the subject property. This injunction, together with further information, is set out within the legal pack. Bidders are deemed to be bidding with full knowledge thereof.

Anyone know who bought this?
It looked like a nice building before the works ...

These plans have only just been available on alconet and the plans published on alconet are not the full set submitted to the planning dept, i have seen these and the full set highlight the discrepancies and complaint i have with the planners.
I hopt these are not "missing"
